The registration process typically includes submitting documentation to prove the origin of the goods, ensuring compliance with the agreement’s terms, and facilitating smoother trade between the two countries.

Rules of Origin (RoO) Under IND-AUS ECTA


Rules of Origin (RoO) under the IND-AUS Economic Cooperation and Trade Agreement (ECTA) are crucial for determining the country of origin of exported products to qualify for preferential treatment. These rules help ensure fair trade practices and prevent misuse of the agreement. Key criteria include:

  1. Wholly Obtained Products: Goods produced entirely in the exporting country without any foreign inputs.
  2. Value-Added Criteria: Products that have undergone significant transformation or value addition in the exporting country.
  3. Change in Headers & Subheadings: Products must meet specific changes in tariff classification as per the Harmonized System (HS) codes.
  4. Change in HS Codes: Amendments in HS codes must reflect substantial processing or transformation.
  5. Final Production: The last significant production step must occur in the exporting country before export.
  6. Detailed Product Information: Specific product details must be shared with authorities to meet preferential treatment criteria.
  7. Adequate Working or Manufacturing: Products must adhere to Product Specific Rules (PSR) for sufficient processing.

Proof of Origin of Product


To verify the origin of goods under IND-AUS ECTA, exporters must provide:

  1. Digital Certifications: Issued by approved government organizations.
  2. Paper Certificate of Origin: In electronic or hard copy format from the relevant authority.
  3. Exporter Declaration: A certificate of origin declaration by a licensed exporter, meeting IND-AUS ECTA regulations.

Documents Required for IND-AUS ECTA Certificate of Origin


  • Commercial Invoice: Detailed invoice of the goods being exported.
  • Product Description: A clear description of the product to be exported.
  • Digital Signature Certificate: Certificate used for electronic signatures.
  • Mobile No. & Email Address: Contact details for communication.
  • Updated Import Export Code (IEC): Valid IEC number for the exporter.
  • Purchase Order from Importer Company: Order document from the importing company.
  • Organization-Based Digital Signature Certificate: Digital signature certificate specific to the organization.
  • Manufacturer Exporter Declaration on the Company’s Letterhead: Declaration from the manufacturer-exporter verifying the origin and details of the product.
  • Purchase Bill: Document detailing quantity, origin of raw materials, and consumables used in the 
  • product meant for export.

Process for IND-AUS ECTA Registration


  1. Filling of Application: Complete the registration form with the respective authorities for the registration cum membership certificate.
  2. Documentation: Attach all required documents and details about the products and the nature of the firm to the completed application form.
  3. Payment: Make the payment on the portal to finalize the registration process.
  4. Issuance of Certificate: After submission, authorities will verify the details. Once verification is complete, the Certificate of Origin will be issued to the applicant/firm.

Product Eligibility under IND-AUS ECTA Agreement


For a product to be eligible for preferential treatment under the IND-AUS ECTA agreement, it must meet the following criteria:

  • Wholly Obtained & Produced Products: Products that are entirely obtained or produced within the contracting nation.
  • Live Animals: Animals that are bred and raised within the territory of the country.
  • Agricultural Products: Products derived from agricultural activities within the country.
  • Products Made of Animals: Goods manufactured from animal products sourced from within the country.
  • Products Made of Marine Animals: Goods derived from marine animals caught or farmed within the country.
  • Products Made of Natural Resources: Items manufactured from natural resources found and extracted within the country.
  • Product Produced Exclusively in the Country: Products that are wholly produced within the country’s territory.
  • Sufficient Working or Production: Products must undergo adequate working or production processes according to the Product Specific Rules.

Note: Exporters must submit a Certificate of Origin to verify the product’s eligibility under the IND-AUS ECTA trade agreement.

  • Retain relevant information and supporting documents for at least 5 years from the expiry date of the IND-AUS ECTA certificate.
  • Maintain accurate accounting records of production and supply of the products.
  • Notify the issuing authority, customs authority, and importer of any changes affecting the accuracy or validity of the certificate.

Non-Compliance & Penalties:


  • Customs duties will be levied if the product’s certificate of origin does not meet IND-AUS ECTA rules of origin.
  • Parties must adhere to civil and administrative laws and may face criminal penalties for violating customs regulations.
